The Commissioner may authorize a mediator to investigate and to try to settle a matter under review.
When a matter is not settled under this section, the Commissioner must conduct an inquiry under section 56 (Inquiry by Commissioner).
In most cases, the Commissioner will authorize a staff mediator to investigate and to try to settle matters under review. The mediator does not impose a settlement. Rather, mediation is intended to help the public body and the applicant arrive at a settlement before a formal inquiry is initiated.
