Bullying and harassment in the workplace can take many forms, including:

  • Verbal aggression
  • Personal attacks
  • Other intimidating or humiliating behaviours

Employment Standards doesn't have jurisdiction to resolve concerns about bullying and harassment.

Employment Standards can only investigate issues related to the Employment Standards Act. Bullying and harassment is not included in the Act. WorkSafeBC's Operational Health and Safety policies cover bullying and harassment instead.

British Columbia Human Rights Tribunal

Sometimes, bullying or harassment may fall under human rights or discrimination laws. Section 86.2 of the Employment Standards Act prevents Employment Standards from applying the Human Rights Code to complaints. The British Columbia Human Rights Tribunal is responsible for accepting, screening, mediating, and adjudicating human rights complaints.
