Summary

This regulation details the circumstances under which a major junior ice hockey player is excluded from the Act.


Text of Legislation

37.16. (1) The Act does not apply to a player on a major junior ice hockey team if the player is entitled, in respect of each of the first 5 hockey seasons the player completes, to receive a scholarship from the team, or the league of which that team is a member, in an amount equal to or greater than the eligible cost of an academic year of post-secondary educational program in Canada of the player's choice.

(2) In this section, "eligible cost", in relation to an academic year of an educational program, means the lesser of the following:

(a) the cost of tuition fees, compulsory student fees and required textbooks for a full time student to attend an academic year of the educational program;
(b) the cost of tuition fees, compulsory student fees and required textbooks for a full time student to attend an academic year of a comparable educational program offered by a publicly funded post-secondary educational institution in British Columbia.


Policy Interpretation

This section applies to a player in their first five seasons on a major junior ice hockey team if the player is entitled to receive a post-secondary scholarship.
