Under the family law, orders can be made about property before the division of property is finalized by agreement or court order.
These orders can:
- Provide for use of property, such as orders for exclusive occupancy of the home that will determine who stays in the family home while your property issues are resolved
- Provide for interim division of property to fund activities designed to resolve the dispute, and
- Protect property where there are concerns that one spouse may do something that would undermine a fair division of property. These would be used where there is concern one spouse might sell or transfer the property
These orders do not affect any right to ownership and do not impact the final division of property.
