Requesting Files: IGBs/IAs

This page contains instructions and the request form for Indigenous governing bodies (IGBs) and Indigenous authorities (IAs) to request copies of files on children, youth and families from the Ministry of Children and Family Development.

File Request Process

This process is for IGBs/IAs to request full files, and not for urgent or immediate requests. Urgent or immediate requests can still be requested from individual offices of the Ministry and Children and Family Development, and/or Indigenous Child and Family Service Agencies.  

The first step of the process to request full files is for IGBs/IAs to request a list of children, youth, and families who are:

  • Members of First Nations represented by the IGB/IA, and;
  • Currently served by the Ministry or Indigenous Child and Family Service Agencies.

Then, IGBs/IAs will confirm which children, youth, and families fall under their Indigenous Law. IGBs/IAs may then request the files of individuals on that list. Once a request is made, the ministry will process and then disclose files to IGBs/IAs securely online. Read the process documents below for more information.

Background

Authorized representatives of an IGB or IA may request copies of files on children, youth and families served by the Ministry of Children and Family Development and Indigenous Child and Family Service Agencies (ICFSA) necessary for the planning or provision of services under Indigenous laws. Files may be requested before or after Indigenous laws and/or a coordination agreement is in effect. 

The Province brought legislation in place enabling this request process under sections 74(2(e)(v.1) and 79.2 of the Child, Family and Community Services Act (CFCSA).
