Mines application notice of filing

When required by an inspector, notice of filing an application for a mines permit will be published in the Gazette and local newspaper.

Advertising

Publication of a "Notice of Filing" is required in the BC Gazette and local newspaper. The following steps must be taken for publication:

 

Identify a public review location

Research where you will post your application for public review.

A copy of the full application must be made available for review at a location accessible to the public, such as the local library, community center, or government office.

Corporate offices of the proponent or mine site are not considered suitable locations.

 

Identify a local newspaper

Research which local newspaper(s) you will advertise in and their publication schedule. Review the BC Gazette information for submitting a notice for publication. 

 

Draft a "Notice of Filing"

Update the template (PDF, 1.3MB) with your information that will be published in the newspaper. Update the address and contact information to the appropriate mining region of the application. 

Email the following to your regional mines office:

  • Draft of the “Notice of Filing” document
  • Name of the local newspaper(s) with date of publication 
 

Publish the notification

Once your draft "Notice of Filing" has been approved by the regional mines office, submit the “Notice of Filing” for publication.

Note: Failure to obtain approval for the “Notice” may be considered as a failure to comply with Part 10.3.1 of the Code and may result in restarting the publication.

Email the following to your regional mines office:

  • Date(s) of the publication(s)
  • Proof of publication: Send a copy of the newspaper advertising and BC Gazette

Timeline:

  • First advertisement to appear in the publications within 21 days from receiving the instruction to file the notice
  • Full Notice of Work application and Notice of Filing information must be available at the advertised public review location for 30 days following the publication

Use the Regional mines public engagement portal to view Notice of Work (NoW) mine permit applications currently open for public comment.

Comments are welcome from anyone in B.C. who is affected by, or interested in, the mines permit application.

 

Posting a sign

An inspector may require a proponent to post a sign of “Notice of Filing” near the entrance of the mine site.

 

Sample development application sign

The sign can be 48" to 72" off the ground and measure 96" wide by 48" tall.

The following example is for a proposed mine permit area for sand and gravel extraction application sign in the Southwest mining region.

Download the sign template (PDF, 3.2MB) and choose sand and gravel extraction or quarry development, then update the address and contact information to the appropriate mining region of the application.

After the sign is posted

Once the sign is posted at the entrance to the mine site confirm the location with the regional mines office.

Email the following to your regional mines office:

  • Photos showing the posted sign
  • Location of the sign

Timeline:

  • Sign must be in place for 30 days following the publication
